Terms and Conditions - quicksales - Refer a Friend Promotion

General
- Information on how to
enter forms part of these conditions. Entry into the competition
constitutes acceptance of these terms and conditions.
- The Promoter is

- For the purposes of
these Terms and Conditions, carsales.com Ltd includes all related and
subsidiary companies, past, present and future officers, agents,
representatives, employees and assigns.
2.
Entry Requirements
- Entry
is only open to Australian residents who are 18 years or over. Employees
of the Promoter and their immediate families and agencies associated with
this promotion are ineligible to enter.
- The
promotion commences at 12:00am AEST on Thursday 15th December
2011 and entries close at 11:59pm AEST on Thursday 31st May 2012(the
Promotion Period).
- To
enter the draw, participants must;
- Be a member quicksales.com.au;
- Refer a friend to become a new member of quicksales.com.au. On the
quicksales membership sign up page, where prompted, new members must enter
either a valid referrer quicksales username; referrer email address; or
referrer quicksales user number. Once this referee has been validated, the
referrer will then receive one (1) entry into the relevant months draw.
- Referrers must have been validated at the membership sign up point to be
considered a valid entry into this monthly competition.
- New
quicksales members must have completed all quicksales membership steps for
their referrer to be placed as an entry into the monthly competition.
- Members
are able to referrer their friends to quicksales.com.au through the
following channels;
- Notify their friends of their quicksales username, email address or
quicksales user number through traditional means (email/phone/face to
face)
- Utilise the quicksales.com.au send to a friend feature accessed through
'my quicksales'
- Utilise the quicksales.com.au 'links & banners' provided by
quicksales.com.au which can be accessed through 'my quicksales'.
- To
qualify a 'new member of quicksales.com.au' is determined by a unique
quicksales username an email combination.
- The Promoter reserves the right
in its absolute discretion to disqualify:
- Any entries that tamper with, or attempt to tamper with the entry
process;
- Any entries that The Promoter considers manipulative, unrepresentative,
or disproportionate;
- Any individuals found entering who corrupt or affect, or attempt to
corrupt or affect, the administration, security, fairness or proper
conduct of the entry process;
- The Promoter shall not be responsible for any entries that are not
received or are otherwise interfered with due to problems with the
internet or telecommunications services. No responsibility will be taken
by - The Promoter for any incomplete, late, lost or misdirected entries.
3.
Prizes
a. The first eligible entry
drawn at 10am AEST on the first Wednesday of each month during the promotional
period will win a $100 Visa Gift Card (RRP$100). The total prize pool for this
promotion is $600 RRP. The winner will be notified in writing using contact
details provided in their entry and will be published in The Australian on the
following Friday (following the draw).
b. The prize may not be
transferred or substituted except at the Promoters discretion and subject to
state legislation. The Promoters reserve the right to substitute a prize of
equal or greater value due to prize unavailability. Any tax on the prize is the
responsibility of the winner. Independent financial advice should be sought by
any person participating in this promotion.
- The Promoter shall
not be liable for any costs associated with the prize after the delivery.
- The Promoter shall
not be liable for any loss or damage whatsoever that is suffered by any
entrant or winner (including but not limited to indirect or consequential
loss), or for any personal injury suffered or sustained as a result of
taking any prize, except for any liability that cannot be excluded by law.
4.
Draw
- The draw will take
place at Level 4, 449 Punt Road, Richmond VIC 3121
- The winner will be
chosen by a random electronic draw process. The judges' decision is final
and no correspondence will be entered into.

- The winner will be
notified via email and phone contact on the draw date.
- The winners details
will be published in The Australian newspaper - date as above.
- The Promoter reserves
the right to redraw in the event of any entrant being unable to satisfy
these competition conditions, they forfeit or they don't claim the prize.
If any prize remains unclaimed or forfeited through ineligibility or
otherwise, the Promoter will conduct a further draw or draws, as required,
at the same time and place as the original draws but on Friday 7th
September 2012. The Winner will be notified in writing
(via email) as well as in the Australian. The winner/s
of these subsequent draws will be published in The Australian Newspaper on
Tuesday 11th September 2012. The winner re-draw will take place
at Level 4, 449 Punt Road, Richmond VIC 3121 at 10:00am.
5.
Entries
- The
Promotion will not collect entrant's data for other marketing uses.
However, the winner's name and photographs may be used for any future
promotional, marketing and publicity purposes in any media worldwide.
- The Promoter may
require an entrant or prize winner to execute any document necessary to
give effect to item 2a).
6.
Warranties
- The Promoter does not
take any responsibility for any costs associated with entering and/or
accessing this competition including and not limited to Internet service
provider costs.
- If for any reason
this promotion is not capable of running as planned due to any reason,
including unauthorised intervention, fraud, or any other causes beyond the
control of the Promoter, which corrupt or affect the administration
security, fairness, integrity or proper conduct of this promotion, the
Promoter reserves the right (subject to any applicable law) in it's sole
discretion to cancel the competition or to disqualify any individual who
has tampered with the entry process.
- In the case of the
intervention of any outside agent or event which naturally changes the
result or prevents or hinders its determination, including but not limited
to vandalism, power failures, tempests, natural disasters, acts of God,
civil unrest, strikes; the Promoter may in its absolute discretion cancel
the promotion and recommence it from the start on the same conditions
subject to state legislation.
- If the Promoter
becomes aware that a prize winner is in breach of any warranty contained
in these Terms and Conditions or made subsequently to the Promoter may
deem that prize winner ineligible.
- Except for any
liability that cannot be excluded by law, the Promoter (including its
officers, employees and agents) excludes all liability (including
negligence), for any personal injury; or any loss or damage (including
loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of the Promotion, including, but not limited to,
where arising out of the following: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter's control); (b)
any theft, unauthorized access or third party interference; (c) any entry
or prize claim that is late, lost, altered, damaged or misdirected
(whether or not after their receipt by the Promoters) due to any reason beyond
the reasonable control of the Promoters; (d) any variation in prize value
to that stated in these Conditions of Entry; (e) any tax liability
incurred by a winner or entrant and/or (f) redemption of the prize.
