b4 reporting an item as fake please ask the seller questions first
Recently I had an ed hardy item removed from my listing (perfume), as it was reported as a fake item. If the person/s who reported this to Oztion & brandwatch had of asked me, the seller, a few questions, all of the drama that occurred after could of been avoided. A simple question is all it takes, if you don't get a reply/ answer, then assume what you want & report. It is not a very pleasant thing to go through, legal email, investigation, it is very stressful - even if one has nothing to hide, still not pleasant. So now I have a 'letter of authenticity' for my ed hardy items I list, & I will be making sure I state that in my listings, & forward a copy to Oztion, so this doesn't happen again. So to save another seller going through this terrible experience, just ask a simple question before you assume the worst & report the item. I must say though, throughout this whole thing brandwatch was very supportive, & willing to make sure this was cleared up quickly to save me any more stress. Please don't go off at me for opening another thread, (my other on 20/8 - re: ed hardy item removed)  I opened this because it's about a different topic, & I am now thinking that I have put it in the wrong section? Not sure, but it's about a perfume, lol

I didn't see your other thread and from what I understand, even if items are reported by me or anyone else, Admin won't actually do anything about it unless we have the rights to.

Any company or individual or their authorised representative that holds registered intellectual property (IP) rights can report any listings that infringe their IP to OZtion by sending us a copy of the registered IP documentation and the listings will be removed.

Maybe it was reported by the company?
As for emailing the seller first, I think that's a personal choice. I once found an ipod nano, that was the title, in the listing it clearly stated that it was a fake and not actually an ipod nano but just like one!

Hi, how do you know it was reported as being counterfeit. It could have been reported as lots of things like wrong category, too many listings etc etc. I've never had an item removed so I'm not sure whether you get an email telling you on what grounds it was removed.

It's really not up to others to ask questions of sellers regarding if an item is fake or not. The report button is there so people can report suspect items anonymously (besides admin) then admin can check the item for themselves.

Regrettably I doubt many people would ask a Seller this first  , why ? Well why would someone selling fakes admit to it ?
Unfortunately OZtion is rife with fakes and it's extremely difficult according to Admin to act on these listings unless they are 'proven' to be a fake and that is usually after an item has been purchased and has been identified as a fake by an authorised outlet .

It's refreshing to know that it appears in your case that your items are not fakes , I have looked at your other items and see that your Gucci Sunglasses appear to be genuine , which is really nice to see .

Perhaps wear this with pride knowing that your item that was investigated has proven to be genuine

I agree with above poster. Buyers shouldn't have to ask if items are genuine.
I have my eye on a Prada bag, have no idea if it's fake or genuine. I don't buy name brand and have no idea how much a 'real prada is' It's a bit pricey and I'm not paying big dollars for fake that will fall apart ... so I passed.

Thankyou for all your replies, & you are right when I think about it now... Not everyone will ask the question, though I do. It pays to mention everything in a listing, so everything is clear & a potential buyer doesn't have to ask questions.. I see that now.. If I see something I like, brand name, I always ask the seller a question if real or fake, many are honest in their answers, & yes, the majority are fake/ copies. (I ask the question in a nice way :-) Those replies, I thank them for their honesty, if I don't get a reply, which I haven't only a few times, I steer clear from it & anything else they sell.  At least now, I don't have to worry about it anymore, though I am getting a letter of authentication about any designer items I list, eg: the sunglasses, just so I don't have to go through all that stuff again :) Might be a good idea for anyone selling authentic items to have an authentication  letter handy if their items are ever questioned, I wish I had of thought about it before. Sorry, I didn't mention before, I got an email from admin, advising me that my item had been reported by the report item button, I had lots of emails back & forth with them about this. Also brandwatch told me they got my details (along with other sellers) emailed to them, all they would say was, not from Oztion. Anyway thanks again, I appreciate the new perspective on this, & I will definately be changing the way I do my listings, & include every piece of information possible.

Also, I just had a thought 'I am going to have to be very careful with this letter' I wouldn't want it to get in the wrong hands & be altered in anyway, maybe if I just email a copy to Oztion, but if individual people ask to see it before buying, I'm not feeling that good about emailing it to people as I think that would be irresponsible on my part, & could easily be duplicated & altered to someone else's gain...

There's no need to show any such letter to any potential buyer as like you mentioned it could be used , most wouldn't even know you have it etc. You could forward a copy to Admin and keep a copy of the email you sent Admin for reference , as it's highly possible Admin might not keep such records etc.

Just list your items as usual , and deal with any enquiries as they come.

i have constantly reported fakes to oztion for 11 months now..also brandwatch..but im not the operson who reports perfumes phone covers ect..i have reported the garments.that i know for sure are fakes..i bought over 1000.00 worth of this junk within 3 days early last year as my daughter was starting a haidressing school and beauty..to find out after i recieved the stuff and after washing it only 2 or 3 times on a very gentle hand wash cycle also by manual washing in a sink that they faded badly and started to fall apart..i was out of work at that time and struggled to buy this stuff..she also got picked on a bit because people could tell they were fakes.,.how sad..not a thing i could do at all..the sellers were not willing to refund unless i paid for return costs.and when i did return them i lost half my money an 6 items out of 38..the rest i was stuck with..so now i want you all to know that i constantly report all these garments that are fakes.and believe me i know what im looking at..  but i didnt report the perfumes as i never bought any..onlt tee shirts shorts swim suits ect..recently i have noticed that the sellers who had the garments have returned thinking they are safe..but i have news for them..i just stood back for 6 weeks to watck the ed hardy pages grow to 5 pages of mainly fakes..guess what..i have contacted the head office also brandwatch and a few other contacts..soon all this rubbish will again be removed.and foor the ones who were warned and had their stuff removed and have relisted it again..they will be licked off..but that wont stop the rip offs..they will again re regiuster with an alias with false credentials..but i daily watch that site and again will endeavour to get it removed over and over again..for my own get back for my losses also to protect the poor people and unsuspecting buyers from buying this garbage..i since have been buying genuine ed hardy only from their shops..yes they cost more but at least they dont fade.dont wear out quickly.and have the look of a beautifully made product..    does this make me a bad person..no..but the crooks who read this and are the ones knowingly importing these fakes and profiting off the innocent..all i can say serves you right if you get stuck with the stock.and also custons get tipped off names get given ect.and future stocks get consfigated at the airports.and they lose out as the supplier has already been paid..and it's not their problem if it's seized..   im watching oztion and always will..you may remember my add i sometimes put on there warning people of the fakes..with the nice vanessa amorosi picture.wearing genuine ed hardy..i have spoken..g
